Chennai: Madras High Court has allowed the Income Tax Department for the Array of the legal heirs of the former Minister of Justice JAYaLalitHAA as a party respondent in the case of a fortune tax delayed by him since 2008.
Judge Bangku R Mohammed Shaiq was given two weeks to the department to add J Deepa and J Deepak, the legal heir of Jayalalithaa as a party over this case.
“Also sure whether other petitions claim legal heirs are waiting in front of the court,” Bench said.
The problem is related to the appeal which is transferred by the Income Tax Department that challenges the decision of the income tax appeal court in connection with the processes transferred by the Department for recovery of income tax and arrears to more than 16 crores.
The department has told the court that former Poes Minister Poes Residence ‘Veda Nilayam’ and other properties have been attached in connection with tax arrears.
When the request to listen, the advice for the department said that so far, the department could not ensure the actual JayaLalitHaa legal heirs and now because the High Court had declarged Deepa and Deepak as legal heirs they could be added as party respondents.
Record submission, the court directed the department to submit a suitable memo to add it as a party for this case and postponed hearing after two weeks.
