Jammu: J & K Administration has tweaked the domicile rules to allow the original female partner to get married outside the union area to file and get a permanent residence.
Until Grant of J & K Domicile Certificate (Procedure) Rule 2020 is changed, the term “partner” applies in this context only for non-kashmiri wives from the original man.
According to commands issued by the Commissioner and General Administration Secretary Manoj Dwivedi, every outsiders who marry indigenous people will be eligible to find a domicile certificate based on the domicile status of husband or wife.
The original woman married to non-Kashmir can so far only get their children to submit a domicile certificate.
The documents needed for the issuance of domicile certificates for non-original pairs include legal marriage partner papers and evidence.
The appointed authority for the issuance of certificates is Tehsildar.
Until article 370 and 35 A canceled, there is no provision for the issuance of a permanent resident certificate to genuine women who are married outside J & K.
This has created a situation where a local man who marries outside J & K can provide a permanent residency At his wife while local women married outside will lose their rights.
J & K President of BJP Ravinder Raina called the change “historic decision to end injustice moored by J & K girls by the previous government”.
Former Deputy Minister and Senior Official BJP Kavinder Gupta said, “Today, our daughters and their partners will be able to obtain ownership rights to their existing traits, in addition to the traits they now buy at J & K.”
