Mumbai: Jet Airways Staffers has transferred the National Law of Appellate Tribunal (NCL) challenging certain aspects of the Consortium Street Resolution plan approved by the National Law of Tribunal (NCLT) on June 22.
The staff also did not approve the compensation offered by the consortium with a slightly more than 3,000 (35%) of almost 9,000 supported employees and 5,500 (61%) did not collect sound.
Bharatiya Kamgar Sena (BKS) and Jet Airways Cabin Crew Association (Jacca) submitted a request before NClat on Wednesday against the consortium, a former professional resolution, the Jet Committee and Jet Monitoring Committee.
Arvind Sawant of BKS said: “We have two concerns, one is a pending contribution of jet staff and the second is about their work, their recovery.” Last month, TOI has reported that Jet staff have planned to appeal.
Of the 4,000 strange staff who remained with jets for more than two years after surgery was suspended in April 2019, only 50 were maintained in Jet 2.0.
The remaining staff have been inhabited from the land handling company that have not been formed, in accordance with the planned consortium resolution.
To get support for its resolution plan, the consortium has floated proposals for jet staff where they get stock equity and control management of the land handling company.
Among other benefits, the proposal includes cash payments of Rs 22,800 to each staff, which includes Rs 11,800 as a replacement for their parents’ medical expenses, their children’s school fees, the purchase of stationery, and refill stationery.
But the condition of the consortium is that the proposal is only valid if at least 95% of jet staff choose support from the resolution plan and not challenging their approval.
Because only 35% chosen, the proposal has been abundant, said the consortium, in communication on the results of voting, sent on Thursday.
Advocates Rahul Oak, representing BKS and Jacca at NCLlat said: “Our appeal does not oppose the rise of jets, this is about violations of the main provisions of the Labor Law.
The workers have been transferred to companies that currently have no operations and can be liquidated at the wisdom of the new owner .
“The benefits listed in the current die proposal are for the above payment mentioned in the resolution plan.
NCLT orders have mentioned RS 52 Crore as payment for staff contributions.
Apart from this, whatever remains of the liquidation value owed to staff will be paid to them based on priority, the command has been said.
Last month, the consortium had said that the value of liquidation – which was estimated the realization value of Jet Airways 1.0 assets at the demand for bankruptcy – owing the workers and employees was around Rs 100 Crore.
It is about 8% of RS 1,254 Crore received by jet claims owe his staff to the payment of Provident, percent, leaving Encashment and about six months of salary.
