Judge sets hearing to reconsider Trucker 110 years old

Golden: A truck driver, was sentenced to 110 years for an explosive accident that killed four people in Suburban Denver, moved a step closer Monday to potentially decrease.
Judge Bruce Jones scheduled a hearing for January 13 to reconsider Rogel Aguilera-Mederos sentences following extensive anger over his punishment and unusual demand by the prosecutor to review the problem.
During the virtual audience to discuss requests, one of the lawyers Aguilera-Mederos, James Colgan, said the defense needed some time to conduct research to see if there were similar cases that could help guide his approach.
Jones said he wanted to learn more about whether the law allowed him to reconsider the punishment gave him the wisdom to determine whatever punishment he wanted.
He said the victims would be able to talk to people who heard about whether Aguilera-Mederos must be matched.
But he noted he didn’t want them to get past the stress unless they wanted.
“I am a prisoner’s audience if they want to talk to me,” he said.
About 5 million people have signed the online petition looking for clemency for Aguilera-Mederos.
In addition to the demand for prosecution to lower the sentence, Aguilera-Mederos has asked Clemency from Colorado Gov.
Jared Polis.
Last week, Alexis King’s lawyer said in a statement he would look for a period of 20 to 30 years in the 2019 vessel in Interstate 70 in Denver.
He said that the range of punishment reflected “the right results” for Aguilera-Mederos’s behavior, noting that the accident was not an accident.
After hearing Monday, the king said his office made a re-consideration request to give a court ability to impose punishment that was not bound by the Mandatory State Infidel Law.
He said the judge, knew his case well, was in the best position to decide on a new sentence and urged people to be patient because the court process played.
Jones imposed a sentence of 110 years against Aguilera-Mederos on December 13 after finding it was a minimum term mandatory set based on state law.
“I will declare that if I have wisdom, it will not be my punishment,” said the judge during the trial.
Leonard Martinez, another lawyer for Aguilera-Mederos, said the range of newly requested district prosecutors was not consistent with similar cases in Colorado and the United States.
Colorado’s law allows for sentences for crimes considered violence to be modified in the case with “unusual and relieving circumstances,” but those sentences cannot be valid until 119 days after someone enters the prison.
King’s lawyers and defense believe Jones can impose new sentences and decrease before that and indeed need the effect later.
Aguilera-Mederos testified that he transports wood when the brakes in the Semitrailer failed when he fell steep levels from the interstate 70 at Foothill Mountain Rocky on April 25, 2019.
The truck was hijacked to another vehicle, repairing a chain reaction accident and fire ball that consumed the vehicle and melted the part Highway.
He cried when he apologized to the victim’s family on a sentence of December 13.
“When I saw my accusation, we talked about a murderer, who wasn’t me,” he said.
“I never thought about hurting anyone all over my life.” The prosecutor believes that he should use a ramp designed for such a situation.
Aguilera-Mederos, for his part, said he struggled to avoid traffic and tried to shift to slow down.
The accident killed Miguel Angel 24 years Lamas Arellano, William Bailey 67 years old, Doyle Harrison 61 years old and 69-year-old Stanley Politano.
The relatives of the victims supported at least some time in prison on hearing his sentence.
