Kochi: The Kerala High Court on Friday provided anticipatory guarantee to two former Intelligence Bureau (IB) officers and two former police officers in the case of the alleged ISRO Nambi Narouan frame in the 1994 espionage case.
Giving them anticipatory guarantee, justice Ashok Menon said former The officer should not be made to face a similar situation forced to undergo a raised reward in prison for interrogation after retirement that occurred a quarter of a century ago.
The court said there were no indications or materials, regardless of rhetoric that foreign forces had hands, and argued that the applicant was entitled to anticipatory guarantee.
The first officers accused Vijayan, the two accused Durgadutt, seventh accused of RB Sreekumar, and 11 accused PS Jayaprakash.
Vijayan is a special branch inspector at the Vanchiyor Police Station which allegedly submitted an excessive report by two Maldives women and their relationship with ISRO scientists.
Durgadutt is the Vanchiyoor Station Sub Inspector who allegedly performed the initial probe based on the first accused report.
Sreekumar, an IPS officer Gujarat cadres who are part of IB, allegedly helped state police in the probe.
Jayaprakash is a central intelligence officer who is part of the IB team that helps state police.
A special investigation team led by the fourth Siby Mathews, which digs crime, has conducted an inquiry and IB officers are part of the team.
In the anticipatory bail application, Sreekumar and Jayaprakash argue that they did not interrogate Nambi Narayanan.
Vijayan and Thampi argued that they were junior officers who registered this case at a reasonable suspicion of Maldives and because of the suspicion of their relationship with high officials and ISRO scientists.
All of them argue that they have retired and old.
