Chennai: Claim of a motorcycle motorcycle accident has directed an insurance company to compensate for 63 lakh to the family of an assistant engineer with PWD who was killed after a two-wheeled vehicle dropped it when he crossed Jalan Walahbad-Padappai.
According to the request by family members, the victim of Maniarasu crossed the road near the Karanithangal bus stop on April 18, 2018 when the accident occurred.
Maniarasu was accepted at the hospital, where he died on the same day.
The insurance company denied complaints that the Petitioner’s family had not sent enough documents to prove their claims.
After reading the submission of both parties and also documentary evidence, the court held the accident occurred due to negligence by the driver.
The court further noted that during a cross examination, insurance companies did not raise suggestions about no availability of any supporting documents from the Petitioner’s side.
These documents also indicate that motorists have a SIM and insurance and hence insurance companies are responsible for paying compensation to the victim’s family, the court states.
The deceased was 55 years old during an accident and worked as a PWD assistant engineer.
Considering various factors including loss of dependence, loss of love and affection to family members, medical expenses and other factors, the court arrived with a number of 63 lakh as compensation.
