New Delhi / Kolkata: The Supreme Court on Monday refused to entertain BJP’s defense, trying to spread the central paramilitary forces in Bengal for “free and fair city polls in Kolkata” and asked the party to approach the Calcutta High Court.
Justice bench L Nageswara Rao and Justice B Gavai said the problem in the petition could be decided by HC, who would be aware of the land situation in the state.
It allows a party to pull the petition to approach HC.
In related development, Calcutta HC, who heard two pills related to Civic polls, is likely to give her assessment on Tuesday.
Chairman of the Chief Justice of Prakash Shrivastava and Justice Rajarshi Bharadwaj indicates this to the lawyer who has asked permission to make a written submission about this issue.
Senior Maninder Singh Advocate said SC has agreed to intervene in the selection of Tripura City and pass instructions to ensure free and fair selection.
Singh begged a similar order forwarded in the BJP application also because the party candidate gained threats and was pressed to attract their nominations.
He said no pine filed in complaints by BJP candidates.
But the bench said SC should not be the first forum to decide on this problem.
“We do not have the means to know the land situation there and legal issues and order in civilian polls.
HC is more suitable to decide.
Once we start entertaining this, it will not end,” Bench said.
The APEX court has last month entertained the petition submitted by Trinamool in the local Tartrura Agency for HC on vacation.
