Chennai: Madras High Court on Friday refused to stop further investigations into Kodanad Estate Murder and Robbery Case.
HC argues that further investigation can be done at any experimental point.
Justice M Nirmal Kumar passed the order while rejecting the request transferred by witnesses prosecution N Ravi tried to hold the state police from starting further investigation in this case.
According to the Petitioner, the police have initiated further investigation in this case even without his personal consent of the judge concerned.
“The Supreme Court has explained that the previous agreement is a must to start further investigation,” he said.
He further believes that further investigation can be allowed only until the trial starts in this case and seeks a court to direct the trial court to conduct trials every day and complete the trial in the specified time.
Opposing the application, the state argues that Section 173 (8) CRPC does not determine that previous permission from judges is needed to begin further investigation.
Putting aside the political motives behind starting further investigation in this case, the country stirred that prosecution would ultimately put the truth.
“We have no intention of slandering anyone,” he said.
“Moreover, the problem is the promise of polls about the ruling party.
The government has promised to find a logical conclusion in this case.
