Kundra’s businessman has filed a written record in the anticipatory assurance application in the Bombay High Court, in connection with the pornographic case involving Poonam Pandey and Sherlyn Chopra.
The court, last week postponed hearing in this case for Monday, November 22.
In his written record, the Kundrra Law Team was led by Advocate Prashant Patil and advocated Suvure Swapnil and no cases under Section 67, Nor 67 (a) was made against the applicant or opposed the other co-accused, in the current prosecution.

In a statement to Etimes, Ambure said, “The prosecution was asking to argue that the video of Sherlyn Chopra and Poonam Pandey were a problem of violations.
This is a problem note that Pak Kundra does not play a role in manufacturing or distribution.

In fact, Ms.
Chopra and even Pandey said that they themselves made videos like that and it was done by them to make commercial profits.

Patil added, “We have sent an assessment and a brief note that shows how the content / video does not attract 67A from the IT law.
The ‘explicit’ expression means, ‘is clearly declared and precisely and or prescribed sexual activity and detailed.” While the expression of ‘sexual activity’ is defined in the Black Legal Dictionary as ‘physical sexual activity or both people involved in sexual relations’.
”
They also accused Kundrra, “totally not connected with the creation of content, publication or even transmit the video.”
They also argue that “videos may be erotic but do not involve physical sexual activity or both people involved in sexual relations.”
Overcoming an investigation involving the ‘HotShots’ application, lawyers stated that, “No content displayed on the ‘HotShots’ was created or uploaded during the period that was connected to it.”

Replying the charges submitted by Chopra and Pandey, they quote in the application that content, “not sexually explicit as needed under 67A from the IT Law.
Also, MS Chopra and MS Pandey, through their personal OTT application provided by the applicant company Full control over broadcasting and distribution, and have received remuneration from it.
”
Then go to state that Poonam and Sherlyn are equipped with a platform where they can have interactions with their fans who pay for subscribing.

Bombay HC in July received the Anticipatory Guarantee Application of Sherlyn and Poonam in pornographic cases.
After hearing their requests, the court announced that there was no coercive action to be taken against the duo until September 20, 2021.
The same thing has also been given to Kundrra and extended until November 25.
Duo has stated that they have been forced by Kundra to photograph the films that are rated.
