Chennai: Land Deprivation by selected representatives is not only dangerous but the threat to democracy itself, said Madras High Court, added that which is why the constitutional court repeatedly insisted that candidates who had a serious criminal background might not be permitted to compete in the election.
“When elected people hold power under the constitution and provisions, they are bound to maintain integrity and honesty and maximum service in their duties,” Subramaniam Justice said.
“This court is the opinion that is considered that selected people involved in the activities of land seizure are far more serious than land robbery, all of which are ordinary citizens.
Thus, such land robbery, which has political affinity, must be prosecuted without relief punishment, “Add Justice Subramaniam.
Noting that the strength given to the executive, elected people and other authorities such as swords, the judge said, “These people are expected to be attentive, devoted and acting with responsibility for accountability.” In terms of indulgence in any illegal activity including vile violations such as reaching government land, such allegations are carried out by selected people and executives and authorities must be interpreted as to the community in general and they must be prosecuted, the court is said.
The power given to such authorities is provided by the people.
When such strength is harassed or misused, then they act against the wishes of the people and therefore, the action must begin without a time interval, the court added.
Noting that ordinary citizens who are aware of the violations by selected members will not take them to government notices because of fear, the judge said, in such circumstances, anonymous information must also be asked.
The court also observed that even though it was a police duty and income authority to act in such cases, they were actively or passively colluding with land robbery.
“Discipline in the police department slowly deteriorates, which is not only seen, but experienced by the wider community,” said the court.
