LDF Govt targets Lok Ayukta; ‘Black Act’, warned legal experts

Thiruvananthapuram: The state government is set to change Kerala Lok Ayukta acting through regulations to prevent each verdict from the anti-corruption agent to bind it, the steps that are legal experts are executive attempts to make the institution of Lok Ayukta Omompong and to measure the clear authority belongs to more justice high below the principle of “power separation” which is mandated constitutionally.
The draft of the Ordonance of Kerala Lok Ayukta (Amendment), 2021 was sent to Governor Arif Mohammed Khan for his approval.
Draft Ordinance has proposed Amendment Act – Kerala Lok Ayankta Act, 1999 – by replacing sub-sections (1) of Part 14.
This section empowers Lok Ayukta or Upa Lok Ayukta to make a declaration in his report that a public servant, against who the complaint was made , it should not continue to hold his position if his guess on him / he is proven.
“Where the competent authority is the Governor, the Kerala Government or the Minister of Chief, he will receive a declaration,” it declares further.
This is part of the part that makes the verdict bind the government and is now proposed to be amended.
