New Delhi: In the midst of a prolonged struggle with the AAP government about the appointment of the public prosecutor to handle the case of agricultural stirrers and three lawyers for cases related to the Northeast Delhi riots, LG Anil Baijal has sent files that quote differences of opinion about the problem this.
This is the first example of LG which calls such a problem to the president after the center changes the GNCTD Law.
LG took a step after his efforts to convince the elected government to approve the failed Delhi police panel.
According to sources, LG has emphasized that the special prosecutor recommended by the police must be immediately appointed.
Delhi Govt felt a nod to the lawyer’s police panel will deny a fair trial to farmers.
The Arvind Corner Cabinet had refused last week to approve the list proposed by Delhi police and instead decided that the AAP panel appointed by the government would handle cases.
These cases were related to stirring on agricultural laws, including those submitted in protests that had turned into violence in several places in Delhi on January 26 this year.
Forty-eight fir is registered with criminals under various parts of the law.
Police Delhi on February 26 asked the Delhi Government House Department to appoint 11 lawyers as SPP to handle all things, including trials, appeals, bail requests, and all the other things related to farmers related to farmers.
Arguing that the cases are sensitive in nature and need careful handling in the time of time bound by the gravity of violations and implications for law and order, LG has in the first week of this month written to the AT government to consider the problem at the cabinet meeting.
He emphasized that Delhi’s police request was valid.
In a separate decision, the Cabinet also refused to give a nod to another panel of three lawyers recommended by Delhi police for the case of Northeast Delhi riots.
The elected government stated that the central government through LG pressed the cabinet to approve the Delhi police panel.
There is a consensus in the cabinet that allows lawyers suggested by Delhi police who appear in the case of farmers will seriously inhibit legal parity and will not be fair to the defendant farmers who have the right to impartial trials.
LG tried to sort this problem with the elected government at a meeting with the Minister of Home Affairs Satyendar Jain, carried out through video conferencing, but the problem remained unresolved.
A official said that in such cases, the file was forwarded to the Ministry of Home Affairs from the President’s office and the latter made a decision that could be approved by the President.
In the same situation about the appointment of lawyers for the North-East riot case, LG had last year referred to differences of opinion to the approved Delhi police officer and panel.
