Bengaluru: In a big assistance for 45 students holding an Indonesian citizen (OCI) card abroad, the High Court has passed the command while directing the Karnataka exam authority to register it for CET-2021 in accordance with the notification on June 14, 2021 and allow them to take the exam.
Justice Sachin Shankar Magadum passed this order after hearing the petition filed by Alekhya Ponnekanti and others.
“If the applicant is not registered with Kea, it will be a loss that cannot be improved for them and can even take all future prospects in their careers.
Therefore, I am the view that a direction needs to be spent while waiting for consideration of all these related points Asked by rival parties, “said the Judge.
Ajoy Kumar Patil, one of the advisors representing the applicant, told the court there were around 200 institutions and around 55,000 seats would only be available through CET, including institutional seats.
Nitin R, another advisor, was taken to court notice that because of a pandemic, the council exam was canceled and, therefore, it was very important that students who intend to pursue technical courses were allowed to appear for CET.
Both of them argue that the applicants have domicile in India and pursue schools for more than seven years and, therefore, they must be treated with a different footing.
They argue that notifications under the challenge, the applicants from getting entrance tickets to government seats in government / private universities.
They stated that HC had held a government 5 of the selection of Karnataka candidates to enter the government seats in the rules of professional education institutions, 2006 so far prescribing Indian citizenship needs to be interpreted so that it includes OCI card holders in the definition of “citizens” as referred to in section 4 of laws Citizenship, 1955.
Appears for state governments of state, additional advocacy General Dhyan Chinnappa claiming citizenship falls under Domian and central government countries bound to follow instructions issued by the center.
Quoting the notification issued by the center on March 4, 2021, he argues that even if it is not included in the 2006 regulation, it will be relevant and therefore, applicants who fall under the OCI category are excluded and their complaints cannot be considered in this case point in time.
According to him, even if the notification of March 4, 20021 is considered prospective, it will not apply to the applicant because they have not secured the entrance ticket.
