Ahmedabad: The Archiving Court case cannot be called a cruelty and divorce cannot be given on the grounds that a wife continues to pretend against her husband, the Court in Gandhinagar said while rejecting a divorce petition submitted by a 30-year-old man.
This case involves couples who live in the Chandkheda area.
They got married in June 2015.
Her husband submitted a divorce request at the senior civilian judge court in Gandhinagar in 2017, accusing atrocities in the part of his wife.
A complaint against the wife is that she is not ready to adjust to her in-laws and get used to fighting with her husband’s parents.
He was also accused of insisting about abortion when he was pregnant in 2016.
The wife also accused the inaclewes of his pressure to stop his pregnancy.
The court refused the husband’s claim for the behavioral problem in the part of his wife said that he could not provide evidence for this effect.
However, the husband also stated the complaint that his wife continued to archive litigation to harass his family and cause financial loss.
He quoted police complaints that his wife had submitted the Chandkheda police station in 2017.
He also proposed that his wife first approached the Ahmedabad family court and submitted an application.
In addition, the woman filed a complaint under a household violence law with the Masters Court in Gandhinagar, who ordered it to pay for its maintenance.
Later, the wife submitted another application that seeks to recover the amount of maintenance.
After hearing this case, the court rejected the divorce petition that said, “only apply for applications and maintenance of domestic violence (which legally has the right to do) and where he managed to prove that the case could not be called atrocity.”
