Ahmedabad: The Gujarat High Court on Tuesday issued a notification to the state government in response to the Pil submitted by a doctor based in Gandhinagar who was looking for a ban on loudspeakers for the prayer) Mosque in Gujarat, claiming that it created voice pollution and violates the basic rights of citizens.
Dharmendra Prajapati, a resident of Sector 5C in Gandhinagar, complained that although not many people appear to offer prayers in the mosque in their neighborhood, Muezzin uses a loudspeaker five times a day to recite Azaran.
He claimed this caused great discomfort and was a disorder for people living nearby.
People have the right to peace and tranquility.
The head of Justice Chief Aravind Kumar and Justice Ashutosh Shastri asked the Petitioner’s advocate, Dharmesh Gurjar, how much volume of the loudspeaker.
Lawyers quote the guidelines and submit that the allowed boundaries are 80 decibels, but there is a volume of more than 200 decibels during the aziversity.
The court further asked about sound pollution made during wedding procession and other celebrations.
Lawyers replicate that marriage occurs once in a person’s life and playing hard music is understood, but for people who do not believe in Islam, listen to loudspeakers that blared five times a day are sound pollution.
Based their argument about the command of the High Court of Allahabad in connection with the rejection of the permission to read Azaan at a loudspeaker against the decision of the local authority during locking, the Petitioner claimed that he had complained about the activity to local authorities but had no effect.
The applicant also believes noise pollution by loudspeakers “causes severe mental illness, physical problems to old people and small children and also affects work efficiency to general in general.

Citing legal provisions, pills claim that the use of loudspeakers without permission from local authority violates the law.
“There is no valid written permission obtained by Muslim community people when using loudspeakers to offer prayers,” pills rang.
It also quotes orders by the Supreme Court to assert that no religion is determined that prayer is done by disrupting the peace of others also does not preach that they must go through a sound amplifier or beat the drum.
The Applicant further claimed that the use of loudspeakers was not an integral part of Islam because in the past when the technology did not exist, Azaan was read and Namaz was used to be offered regularly at the mosque.
Muslims cannot explain why Namez cannot take place without the reading of Azaan through loudspeakers.
The court has searched for government replies on March 10.
