Madurai: Madras High Court on Monday canceled a 10.5% reservation provided for Vanniyars, the most backward community (MBC) in Tamil Nadu, at the government’s work and entered educational institutions, said it was not constitutional.
The Tamil Majelist Nadu has in February passing the ruling pilotmk bills that provide an internal reservation of 10.5% for Vanniyars, with the powerful DMK government issued orders in July this year for its implementation.
It has shared a 20% aggregate order for MBC and the Densikas community into three separate categories by returning caste and giving ten percent plus sub-quota for Vanniyars, officially known as Vannakula Kshatriyas.
“Has the state government empowered to conduct internal reservations.
The Constitution has provided sufficient explanation.
Legislation who provides canceled internal reservations,” Justice M Duraiswamy and K Murali Sankar ruled.
The judges said the state government could not come out with such laws.
This has been explained in the constitution.
Applicants argue that if such reservations are implemented, the Vanniyar community will enjoy reservations in work and entry while 25 other casts under MBC and 68 others must share the remaining quota.
