Mumbai: Deputy CM Ajit Pawar said on Tuesday, “We decided to postpone polls (speakers) to pay homage to the view of the governor and ensure no legal or constitutional obstacles,” said.
He added that the MVA delegation would meet the Governor once again to resolve questions and misunderstandings.
“Even Lok Sabha follows the vote openly for speaker polls,” he said.
The Indian Constitution did not give a role for the governor in the speaker election to declare the legislature, legal experts said.
According to Section 178, the selection of speakers was carried out by the Members of the State Assembly.
However, the rule of 6 Rules of the Maharashtra legislature said the date of selection of the speaker must be notified by the governor.
The post from the State Assembly speaker has been empty for the past ten months since the leader of Congress Nana Patole resigned from a position to take over as head of the State Party.
Talking to reporters, Shiv Sena MP Sanjay Raut took the governor at Governor Koshyari said, “his appointment was not for rejecting legislative home rights, government recommendations and people’s will.” Last week, assembly passed the amendment to rule 6 Maharashtra legislative assembly rules for speaker selection.
This new rule allows the selection of speakers through voice sounds that will reveal who each MLA chooses rather than through secret voting which is the norm.
Governor Koshyari searched for a legal opinion about whether this change was not constitutional.
The state leader stated that the selection of Speaker Lok Sabha followed the voice and amendments was removed by the State Assembly.
Amendments also exclude the words “hold elections” and include words, “to choose the speaker on the recommendation of the Minister of Chief.” Officials said the change made it clearer that the governor had to act on the advice of the minister’s chairman.
MVA and Governor Koshyari have long been on a collision course.
A year after the government submitted a list of 12 nominations for MLC Posts through the governor quota, he had not cleaned it.
The Governor of Koshyari also questioned the Thackeray government because he did not reopen the Hindu place during a pandemic.
MVA also replied to the governor by denying him airplanes to fly to Uttarakhand.
Earlier this month, the Country Cabinet cleaned up amendments to Public University Maharashtra, limiting the role of Chancellor held by the governor, starting choosing a pro-vice Chancellors.
The bill was passed by the Assembly on Wednesday.
