Mumbai: Facing rustic polls in three weeks, the State Cabinet decided to issue a regulation to restore the OBC quota, which was canceled by the Supreme Court, by changing the law of the Gram Panchayat state.
Ordonance will allow the OBC quota in a rural body, with motorists who have been combined with SC and ST reservations, the combined quota will not pass a 50% limit.
Also, the OBC quota will not cross 27% of the chair, according to the existing state legislation.
“This means that the OBC quota can be 10-12% lower than before.
In terms of the tribal that is dominated where the high ST quota, the OBC quota will be very low or non-existent.
In the urban area where STS is very little, the OBC quota can be higher , “said Minister of Food and Civil Equipment Chhagan Bhujbal.
The state follows the route taken by other countries, including Tamil Nadu, Andhra Pradesh and Telangana, he added.
The country faces the sixth poll Zilla Parish and Samitis Panchayat in October 5.
Ordonance quota for the election of urban local agencies is likely in one week, the opposition welcomes the regulation but says it will not help in the upcoming polls.
“In five of the six zilla parishes go to elections, the OBC quota will be ignored because the SC and ST quota is high,” said the former chairman of the Minister and the BJP leader Devendra Fadnivis.
Ordonance is expected to be issued this week.
Next week, similar regulations are expected to be issued to enable the OBC quota in urban local bodies, said sources.
Polling in ten main city companies in the state, including Brihanmumbai Municipal Corporation, is scheduled to be held early next year.
BMC polls matured in February.
The source says that on every local body, the country will first accommodate seats provided for SCSAND STS because this is a constitutional mandated reservation.
This SC / SC quota is based on the number of people in the population.
After this is done, the seat will be provided for OBC, ensuring that the combined quota does not cross 50%.
The OBC reservation itself will not be permitted to cross 27% because this is a quota mandated by the state.
In March, the Apex Court had canceled a 27% reservation for OBC in the Local Maharashtra body on the grounds that bookings, combined with them for SCS and STS, exceeded a 50% quota limit.
The OBC quota can only be permitted after empirical data on the community is collected and if the 50% quota limit is not crossed, said SC.
Empirical data about OBCS has not been collected by the state-class commission of state state and exercises can take months.
When asked whether state regulations will stand in the Supreme Court, Cabinet Minister Chhagan Bhujbal said, “The Ordonance will ensure that the 50% quota limit will not be crossed.
But this is a stop-gap setting.
We will collect empirical data on OBC and send it to court, “He said.
The opposition welcomes the regulation but says that getting empirical data is very important for permanent solutions.
“Also, in a few local bodies, the OBC quota will be very low because the SC and ST quota is high.
There should be some solutions for this too,” Fadnivis said.
Now opposition leader in the state legislative assembly.
