Maha Ordonance in Political Quota for OBC

Mumbai: Facing rustic polls in three weeks, the State Cabinet decided to issue a regulation to restore the OBC quota, which was canceled by the Supreme Court, by changing the law of the Gram Panchayat state.
Ordonance will allow the OBC quota in a rural body, with motorists who have been combined with SC and ST reservations, the combined quota will not pass a 50% limit.
Also, the OBC quota will not cross 27% of the chair, according to the existing state legislation.
“This means that the OBC quota can be 10-12% lower than before.
In terms of the tribal that is dominated where the high ST quota, the OBC quota will be very low or non-existent.

The state follows the route taken by other countries, including Tamil Nadu, Andhra Pradesh and Telangana, he added.

In March, the Apex Court had canceled a 27% reservation for OBC in the Local Maharashtra body on the grounds that bookings, combined with them for SCS and STS, exceeded a 50% quota limit.
The OBC quota can only be permitted after empirical data on the community is collected and if the 50% quota limit is not crossed, said SC.
Empirical data about OBCS has not been collected by the state-class commission of state state and exercises can take months.
When asked whether state regulations will stand in the Supreme Court, Cabinet Minister Chhagan Bhujbal said, “The Ordonance will ensure that the 50% quota limit will not be crossed.
But this is a stop-gap setting.
We will collect empirical data on OBC and send it to court, “He said.
The opposition welcomes the regulation but says that getting empirical data is very important for permanent solutions.
“Also, in a few local bodies, the OBC quota will be very low because the SC and ST quota is high.
There should be some solutions for this too,” Fadnivis said.
