MUMBAI: Following a complaint and objection by the public prosecutor and intervenor in the anticipatory bail application of Mira-Bhayander town planner Dilip Gheware in an alleged Urban Land Ceiling (ULC) scam, special Thane anti-corruption court judge Rajesh Kakani on Wednesday recused himself.
Thane principal judge will on Thursday decide which court will hear Gheware’s bail hearing.
On June 15, whistle-blower Raju Shah and Special Investigation Team (SIT) had filed an intervention and objected to the Gheware’s plea before Thane court judge Rajesh Kakani.
Shah’s lawyer Shekar Jagtap argued that as Prevention of Corruption Act sections have been removed from the case, Kakani’s court does not have the jurisdiction.
Kakani dismissed their plea and heard lengthy arguments by the defence, public prosecutor Shisir Hiray and advocate Shekar Jagtap from intervenor, builder Raju Shah’s side.
Now the new court will have to hear the matter from the beginning.
