Jodhpur: In an important assessment, the Rajasthan High Court decided that a married daughter had the right to the government’s work for compassion.
Perception that a daughter no longer became part of her father’s household after marriage and became an exclusive part of her husband’s household showing a mindset that was outdated, the court observed.
“If a daughter is not married or single, he meets the requirements to look for an appointment for the reason for mercy; and if he widows or divorced, so he also qualifies for the same thing.
He then may not be without the same right, to look for the same right, to look for Promise full of affection, only when he married, “the court observed.
The observation came during the petition hearing submitted by Shobah Devi who stated that his father had died in November 2016 as an employee of Jodhpur Discom.
His mother, who qualified for the work in its place with the reasons of compassion, cannot take a job with health reasons.
Shobha Devi, her married daughter, then filed a job on the land of compassion, which was rejected by a discom stating that a married daughter was not entitled to this work.
The discount argues that since a married woman cannot be considered a dependent, he cannot be considered for work under loving reasons.
But rejecting the argument, justice PS Bhati stated that a son and a girl had the responsibility of old parents and did not matter if someone married or not.
“Discrimination based on sex, married boys are looking for loving appointment, will violate article 14, 15 & 16 Indian constitutions, and thus, discrimination against the daughter married to the son of marriage, and against a son married, and fight A married son, and opposes married daughter vis-a-vis who are not married, divorced, widows or single have been considered unacceptable, “the court observed.
The court ordered the applicant to move fresh applications with directions to respondents to consider the same in the past three months without denying the applicant of land as a married daughter in accordance with the law.
