New Delhi: Special Court in Mumbai on Wednesday rejected the Aryan Khan Guarantee application, actor son Shah Rukh Khan, in connection with the case of cruise drug seizures.
Aryan (23), was arrested with several others on October 3 after the Narcotics Control Bureau (NCB) stormed a cruise ship from the coast of Mumbai and claimed to have confiscated drugs including Charas, has now moved the Bombay High Court.

Taking a strong observation while rejecting a guarantee request, the Special NDPS court in the order of his 21-page noted that Arya regularly pampered itself in drug activities and related to drug vendors.
The following is the main observation made by the court:
* The court noted that the YHATSAPP chat Arya Khan Prima Facie revealed that he was “dealing with illegal drug activities regularly” and therefore it cannot be said that he will not commit similar violations if released on guarantee.
* Held that Aryan knew that his friend and Arbaaz trader together had medicines, and therefore there was a “conscious ownership” even though NCB did not find drugs in Arya himself.
* “Considering Prima Facie’s involvement from applicants / accuses No.
1 to 3 (Arya Khan, Merchant and Dhamecha) in the Camera Commission and serious violations, this is not a fit case to provide guarantees,” said the judge in order.
* Case papers and voluntary statements Arya Khan and Arbaaz traders reveal that they have drugs for consumption and enjoyed, the court records.
* “These things go to show that the defendant No.
1 (Aryan) has knowledge of the contrabanded goods hidden by the defendant no 2 (traders) in his shoes,” he said.
* “Even though there is no valuable found in ownership accusing No.
1, six grams of Charas are found to have accusations No.
2 of which are accused of not 1 (Arya) having knowledge and thus it can be said that it is in conscious ownership.
From the two defendants,” added court.
* In the YHATSAPP Aryan chat, there is a reference for “bulk amounts and hard medicine” and “there is a prime facie material that shows that accusing no contact with people who deal with narcotics that are prohibited,” said the Order.
* “Prima Facie seems to have a case of conspiracy and reduction as expected by prosecution,” he said.

Khan, Merchant and Dhamecha are among a group of people captured by NCB on October 3 for alleged conspiracies, ownership, consumption, purchasing and drug trafficking under the NDPS law.
They are now in court detention.
While Arya and Merchants were submitted in Arthur Road prison, Dhamecha was submitted in a byculla women’s prison in Mumbai.
Aryan Khan and the others have been ordered for violations under the 8 (c) section, 20 (b), 27, 28, 29 and 35 of the NDPS law.
Aryan was in Plea Guarantee told NCB’s opinion that he was involved in the forbidden drug conspiracy and trade that did not make sense, and showed that there was no recovery of drugs made from him.
So far, 20 people have been arrested in this case.
