Kanpur: Special Judge Pocso Court Kanpur Nagar Rajve Singh on Tuesday rejected the application of guarantees accusing Sanjay Gautam who had been charged for kidnapping and physically exploiting a little girl.
The victim in this case stated that he lived with the defendant at his own will and he was seven months pregnant.
Defense advice begged in court that was not true that the defendant had been arrested for the information provided by any informant, and the police claim was wrong.
The defendant did not captivate / kidnap the girl or raped him.
In addition, there were no independent witnesses to strengthen police charges, defense advisors argued.
The defendant had been imprisoned since July 25, 2021.
Because this is the first guarantee application transferred by the defendant and that there are no other guarantee applications delayed in any court, therefore, he must be released with guarantees, defense advisors delivered.
Replying to the defense advisory argument, Adgc Sushil Kumar Verma said the defendant was arrested by the police.
He has lured and married with a small victim with the intention to build physical relationships with him, therefore, the guarantee application was rejected.
The court in the order of observing that after reading the records and evidence of the file and based on the statement of the victim listed in the 164 CR P C there was no foundation for providing guarantees to the defendant, the guarantee application was rejected.
