Mumbai: In complaints of sexual harassment at work, the Bombay High Court has directed a woman to appeal before the Industrial Court in Mumbai against the committee of the March 2020 Committee to reject its charges against the executive, in a large company.
In March, for the first time, the state had notified the Industrial Court as a comparative body under the prevention of sexual harassment in the workplace (prevention, ban, and change) ACT (Posh), 2013, for those who were not satisfied with the recommendations of the internal committee.
HC bench in the decision of July 8, said the relevance of this notification issued in the Department of Industry, Energy and Labor, is an industrial court will be an appeal authority under the POSH Law and the woman can take advantage of the recovery of the appeal before that, to the report and command of the Internal Committee (IC).
Under the Posh Law, a complaint was first assessed by internal or local mechanisms – panels that also have members of NGOs.
The woman approached HC last year with a complaint that since the in-house panel told her “No action was needed” in her complaint that accused sexual harassment, thus rejecting it, she had no place to switch.
His advice Mihir Desai said there was no regulated or notified of the state under the actions or luxury rules and therefore he was limited to approaching HC to the company to cancel reports and order.
He also questioned the “illegal termination” next in June 2020.
The company opposed the petition and also questioned his maintenance.
During the hearing on March 11, the state said Posh ACT provided an appeal against IC reports.
HC has directed the country to provide details whether such an appeal authority is regulated.
On July 8, the state told HC from March 31 notifications.
It made an industrial court in Mumbai appeal authority in this case.
