Madurai: Observing that MP or MLA should empty public property immediately after their term of office was completed and was not expected to squat, Madras High Court on Tuesday rejected the request by a former member of Parliament Aiadmk Madurai R Gopalakrishnan who tried to remove.
The key and seal in his office rented to him by Madurai Corporation.
Gopalakrishnan stated that he had rented a building in Talakulam to establish an office during his term as MP in 2014.
On March 19, a flying squad had examined his office and moved banners in front of the office and sealed him.
He stated that a case was registered by Tallakulam police under the Tamil Nadu Open Places section (prevention of the Handsake Law).
After the assembly selection was completed and the model behavior model was appointed, he had submitted some representations to the authorities to remove the key and the building seal, but there was no step taken.
Therefore, he moved the HC Madurai bench who was seeking help.
Justice N Anand Venkates observed that the careful reading of the resolution submitted by the corporation showed that the property was allocated to the applicant in his capacity as a member of parliament to utilize public spaces to carry out public functions.
“Once the applicant stopped being a member of parliament, he lost his right to occupy the property.
The applicant does not have the right to continue to have property,” observes the judge.
Therefore, the judge observed that the court did not tend to issue any direction that was prayed for by the applicant and rejected the petition.
