Mum: BLDR is fined RS 21L for delayed flat ownership

Mumbai: Bringing to order a builder for a flat ownership of 820 SQFT Mulund (E) which has led to severe difficulties for couples for almost a decade, the State Consumer Commission has directed it to pay them around Rs 19.50 lakh compensation.
The amount includes RS 28,000 transportation costs every time the couple must shift from rented houses and Rs 1.70 lakh paid for leave and license registration.
Couples, Neeraja and Anand Modhey, emptied their flat in 2008 and had to be owned from the developer Kamal Joshi with all amenities, in 2011.
However, the flat was ready only in 2017.
The couple did not take over internal work and replacement.
They moved the Consumer Disputes of Maharashtra State in 2018.
Mastering them, the Commission said, “The opponent to direct that before giving over the flats of the complainant to resolve all the internal work of the flat and in connection with the replace made in the flat as agreed on the complainant and opponent Complete the work of all facilities that will be given to community members in accordance with the agreement.
“It also directs the developer to submit a work certificate in connection with the flat for complainants and provides a certificate from competent authority with respect to a flat and artificial area.
The compensation breaking includes replacement of interest charged to housing loans, rental costs, compensation for delayed ownership and for mental illness and suffering.
The Commission also ordered Rs 25,000 as a complaint fee.
“When the opponent gives a flat ownership for a complainant, they are entitled to a job certificate …
the complainant has the right to get the rest of the work completed by the opponent as mentioned in the agreement …” The Commission refused to accept the Builder’s argument as a delay of 67 days in response to the court notice ,
