Mumbai: Making three people with charges of intending to sell around 13kg ketamine in 2013, special NDPS courts have initiated a mirror process against witnesses who are the prime facies that are associated with prosecution.
While prosecution claimed someone accused, Ramshiromi Pandey (55), was arrested in Sakinaka with medicine, he repeatedly thought he was arrested from his home in Nalasopara.
Defense produced CCTV recordings to strengthen the defendant’s version.
The court said that from the image in CCTV footage, it was clear that the witness and the defendant were seen in Nalasopara.
“…
I came to the conclusion that, the PW-4 (witness prosecution) seemed to have made a false statement before the court, had the knowledge that if the proof was accepted he would help prosecute in proving his case,” The court said.
It was said that it was found “wise for the sake of justice” to at least start an investigation into this matter by issuing the notification of the show to him and find out if he was truly responsible for doing the periaja.
“This show causes notifications to be issued for Abdul Rauf Shaikh, as directed above, will be returned on September 30,” said the court.
“Within several times, there is a tendency to make a false statement in front of the court and therefore, false oath cases increase and except actions taken by the court, this tendency cannot be controlled or examined,” said the court.
The court said the defense showed the situation to prove the possibility of the implications of the defendant in this case could not be ruled out.
“Therefore …
because doubts were created in the truth of the story of prosecution,” said the court.
Making Pandey, businessman Santosh Kumar Singh (34) and Plantation Agent Vidyaprasad Tiwari (45), the court said, “I found that prosecution demands had failed to prove the seizure in the case …”
