Mumbai: More than 37 years after he was accused of killing, a 60-year-old Cuffe parade worker had been released due to lack of evidence.
The court session released Prakash Ratan on Friday.
He was arrested earlier this year after he escaped for decades.
“All the evidence is added to it, even if it is accepted like that, there is still no burden of the defendant.
This is, the defendant cannot be considered guilty of the violations required,” the court said.
The prosecution case was that on September 29, 1984, a police officer on the task of patrol in Trombay saw a man and a wounded boy lying on the road.
The boy, Ankush Dhone, said that six men had attacked him and the man, Akhtar Kazi.
The duo rushed to the hospital, but Kazi was declared dead.
Allegedly that Ratan also among the defendants.
Over the years, one was accused of running out, the others died and three were released.
During the trial, only a police officer was overthrown.
“To be stated that despite many opportunities, prosecution cannot secure the presence of injured ankush.
Even during the previous trial he was not examined, it could not be traced.
The most important witness proof is therefore not available,” said the court.
