Nagpur: Upset with the failure of civil institutions and the government to repair holes on all roads, NGO Janmanch has reminded them of the strict order passed by the Nagpur bench from the Bombay High Court on October 16, 2019, and appealed to implement it.
The majority of city roads, except concrete, have developed a crater-sized hole due to continuous rain, mainly because of inferior quality materials used by contractors, Jankan activists accused.
Civic and government agencies like the Department of Public Works (PWD), Mahametro, and NHAI, among others, have failed to improve the streets in their jurisdiction, they said.
Take aware of the toi report about death because of the hole in September 2019, the division bench then consisting of judge Zaka Haq (now retirement) and Pushpa Ganediwala has treats the problem as a suo motu pill and issued a notification to the commissioner of Nagpur Municipal Corporation (NMC) Abhijit Bangar and later Police Commissioner (CP) Bhushan Kumar Upadhyay.

Janmanch’s appeal came after being clarified in the NMC public body meeting that NMC was not in a position to fix all holes before the end of December.

When appointing Raheel Mirza as Amicus Curiae to compile this case, Justice Haq has been seeking detailed information from NMC and police chief about actions taken against subordinates for negligence.
They also tried to know the number of violations submitted to citizenship and police officials in cases related to accidents due to holes and actions taken against them.
Then, the intervention was submitted by lawyer Anil Kumar highlighted how several complaints committed by civilian authorities through social media did not get attention.

The Civic’s body also told HC on October 16, 2019, that it was in the process of making cellular applications and hosting on the Android platform, which would facilitate registration of complaints immediately.
Janmanch claimed the application was never launched and NMC has also stopped receiving complaints.
