Navi Mumbai: Maharera in a recent order has directed the Prathamesh Harmony Project promoter in the Ulce to hand over the ownership of the flat and shops as many as 34 complains in June, by obtaining a residential certificate, and paying interest for delayed ownership.

Maharera Vijay Satbir Singh member, in order, also stated that the community would be entitled to take over this project if promoters Ajit Singh failed to finish it by obtaining a residential certificate (OC).
According to the complainant, they signed registered agreements for sale for their flat between 2012 and 2015 and pay a large number to the promoter.
This promoter is responsible for their flat ownership between 2015 and 2017.
However, in several agreements, the promoter has failed to mention the date of ownership.
After that, the promoter failed to get OC for this project.
The complainant also claimed that 95% of the work was completed in 2015, but, until 2016, there was no flat left.
Meanwhile, the promoter was made to register this project with Maharera in January 2020, with December 2020 as a settlement date.
The promoter then even got further extension until June 2022.
Maharera Singh members said the respondents were under the legal liability to complete the project and obtain OC at that time.
He directed the promoter to pay interest on the delay according to RER’s actions.
Singh observed that the promoter did not appear for the audience before Maharera, or submit a reply to the record.
Therefore, the authority did not have an alternative but to decide this complaint ex-parte.
Singh further said that since the project was 95% completed in 2015, taking six years to complete only 5% of work unacceptable.
Singh shows that even though the promoters have maintained an empty ownership dating in most agreements, and even though the share of ownership has passed in 2016, there was a delay in the complainant section in the start of the action.
