LONDON: Fugitive NIRAV Modi and Uncle Entrepreneurs, Mehul Choksi – Accused of PNB Crore Rs 13,000 – Has hired Edward Fitzgerald QC, one of the most resilient rows in the UK, to represent them in their respective extradition processes.
Fitzgerald kidding has been described as “Satan Advocates”, after representing controversial numbers such as Hate Bencah Muslim Abu Qatada and Abu Hamza terrorist convicted.
In a career covering more than 40 years, Fitzgerald has won many extradition cases.
He managed to prevent British Indian meaning Dhir – accused of organizing with the murder in 2017 in Gujarat from orphanage who was adopted by 12 years old – so as not to be extradited from England to India in 2019.
He represents the alleged CEO of D-Company, Jabir Motiwala, Pakistani citizens, in his battle against the extradition from England to the US to deal with allegations of drug trafficking and, in extraordinary development, managed to make the US government to withdraw from cases in April 2021.
Motiwala flew back to Pakistan a man free.
He also represents Amrit Singh, one of the three British Sikh men that India was trying to extradite, accused of being involved in a conspiracy to kill Politician Rulda Singh in India in 2009.
The three men were dismissed.
He prevented the extradition of alleged Laururi Love computer hackers to the US in 2018 and managed to get Julian Assange dismissed at the Westminster Judge Court in January 2021, although the decision had been reversed.
He also won a historic legal battle for Gurkhas rights – recruited from Nepal to fight in the British Army – to settle in England.
Fitzgerald, the combined head of Doughty Street’s room, graduated with the first in the classic of Oxford University.
In the room and partner he described as a “tough opponent” the chair of the tactic “get a laugh case out of the court”.
“He is very tough so he can make things really bad,” the legal ranking company said.
NIRAV initially used Clare Montgomery QC, the same lawyer as Vijay Mallya, in the hearing of extradition, but for his appeal NIRAV turned to Fitzgerald.
Fitzgerald won permission at the High Court last July to appeal against NIRAV extradition.
At the hearing of the appeal of NIRAV on December 14, 2021 he managed to get a court that was postponed so he could get an English expert to check India’s latest guarantees.
That alone is an achievement and delayed further extradition cases.
Hearing instructions will take place immediately.
Choksi, who has obtained an antiguan citizenship with investment, is fighting extradition to India from Antigua, which has been given a guarantee in Dominica for medical reasons and is allowed to return to Antigua, from where he claimed he was kidnapped.
Fitzgerald, who has represented Choksi for about a year, told TOI: “The Choksi case involves the most disturbing strength training.
