Non-agricultural land in Jammu & Kashmir can be transferred to ‘outsiders’, government said

New Delhi: Home Ministry Wednesday told Rajya Sabha that non-agricultural land in Jammu & Kashmir can be transferred to “outsiders” – or people who are not permanent residents or have domicile J & K – by the UT government only for education, charity and medical efforts.
“In accordance with the land law adapted from Jammu and Kashmir, the government can, with notification of official sheets, enabling soil transfers, for public purposes such as education, charity and health care purposes,” Nityanand State Minister Rai said to be replied to the question.
On Tuesday, the government had told Lok Sabha that two ‘outsiders’ had bought two properties in J & K since the abrogation of article 370 on August 5, 2019.
RAI said that after August 5, 2019, all the provisions of the Indian constitution were made by J & K, which requires changes in the laws in UT with an adaptation command, so that it is in accordance with the provisions of the Indian constitution.
Apart from adapting the mainland law, ACT BIGAMAM AND KASHMIR BIG LANDED ABOLITION, 1950 – which transfers land to puppies and prescribes the limit for the ownership rights of 182 Standard Canas (22.75 hectares), revoked.
In place, other laws i.e.
Agrarian Reform Law Jammu & Kashmir, 1976, was taken to transfer land to the applicable puppies.
This action prescribes the 100 canal ceiling restrictions (12.5 hectares), Rai told the house.
