New Delhi: A Sri Lankan refugees in Tamil Nadu, who tried in crime and fired a shot from the AK-47 assault rifle in 1988 to escape the police and the crowd who was alert after making a dakoity, would not be released from prison even after 33 The year of detention, the state government told the Supreme Court on Wednesday.
A bench headed by justice A M Khanwilkar on April 25, 2019 asked the MNS government to decide on the petition of Sri Lakan Rajan for remission left and released within four months.
The bench then issued an insult to court notice to the addition of the Head Secretary (home) because it did not decide on the request for remission on time.
The official through a senior advocate Ranjit Kumar submitted an unconditional apology and did not meet the requirements but told the court that the government had rejected the request of Rajan for remission.
Rajan was punished by the Tiruvannamalai district and the judge’s session in 2007 concerning three murder charges, where he was awarded the death penalty, and four allegations of efforts to kill, where he was awarded a lifelong sentence, by using AK-47’s arms.

In the appeal, Madras HC in 2008 has upheld his beliefs on all things, including those under the ARM acting, but featuring a death sentence for a life sentence, so that Rajan faces a life sentence with seven counts.
Rajan did not appeal against HC’s assessment, which reached finality.
In 2010, Rajan submitted an application before the government was looking for remissions for the rest of the sentence.
But, it was rejected by the Advisory Board.
He moved a similar application again on February 5, 2018 and then moved SC which was looking for directions to the authorities to consider his request for the initial release.
In the assessment of April 25, SC has asked the TN government to consider the initial Rajan application and make decisions without being touched by previous rejection of the remission application.
Delay in considering the application has made Rajan to seek initiation of the insulting process of additional major secretaries (houses).
The official was through the standing Counsel Joseph Aristoteles told the court that the decision on the application needed to be taken from Madras HC, which in turn asked the government to seek the trial judge’s opinion in question.
The whole process takes time and then the pandemic disrupts administrative work in the government due to lack of staff.
The bench received an unconditional apology from the official and closed the insulting process.
However, it was said that Rajan could challenge the rejection of his request for remission before the appropriate forum.
The prosecution case was that Rajan, along with co-was accused, committed Dakoitas at the house of one Pitchaikara criminal on July 27, 1988 and when trying to escape in Van Maruti, the police and the general public set a barricade.
To escape from the situation, Rajan was fired from the AK-47 weapon killing three and injuring four others.
Rajan has been prison since July 1988.
