Bhubaneswar: The Country Cabinet cleanses the regulation to change the two city actions that regulate the selection of urban local agencies to comply with the highest direction of the ‘Triple Test’ Supreme Court as a prerequisite for the backward class quota (BCC).
Ordonance will change the 1950 Municipal Odisha Law and the 2003 Odisha Municipal Corporate Law and dropped the BCC quota for the upcoming election.
In September, the government had passed the Odisha City Bill (Amendment) Bill, 2021 to have a BCC quota of up to 27% with a 50% overall quota limit for all categories ordered.
Chief Secretary of the Suresh Chandra Mohaparna said the regulations to change these actions were needed considering the Supreme Court’s verdict in the BCC quota.
SC on December 17 has asked lawyers to communicate with countries to comply with ‘test three’ as a prerequisite before notifying a seat reservation for BCC.
According to SC, ‘Triple Test’ means establishing a special commission to conduct a strict empirical investigation into the properties and implications of retardation, determine the proportion of orders needed to provide local bodies in the light of the Commission’s recommendations, make sure the order will not exceed the aggregate of 50% of the total aggregate The chairs provided for SCS / STS / OBC are taken together.
