BHubaneswar: Odisha Information Commission (OIC) has brought the Kalinga Institute of Industrial Technology (Kiit), Bhubaneswar, under the Translation of the Rights Law on Information (RTI), 2005.
The commission passed the order on August 5 when hearing the appeal submitted by activists RTI Pradip Pradhan in 2014.
According to Oki, Kiit is a public authority in the sense of Section 2 (H) (D) (II) of the RTI Act.
On September 1, 2014, Pradhan has asked the Public Information Officer (PIO) to provide data on the appointment of the former government employee and the central government at the Kiit and allied institutions.
Pio has rejected the application that states that the kiit is not a state or authority based on Article 12 of the Constitution.
Pradhan then appealed first on October 7, 2014.
The applicant accused that the reply given by PIO could not be suppressed based on RTI laws or other land law.
After several audiences, the Commission finally stated in its order that institutions received funds from different governments and institutions.
There was no dispute that the respondent organization performed public function, he added.
According to Section 2 (H) (D) (ii) of the RTI Act, Public Authority means any authority or institution or independent government agency stipulated or formed by notifications incurred or order made by the appropriate government, and includes anything Government organizations are substantially financed, directly or indirectly with funds provided by the appropriate government.
Because the kiit has been declared a public authority, the institution is directed to provide the information needed to the applicant within 30 days from the date of receipt of the order.
