Chennai: Only Hindu can be appointed for teaching and non-teaching posts in educational institutions that are fully funded from Temple’s revenue, the Tamil Nadu government told Madras High Court on Friday.
There was a clear bar against non-Hindu recruiting to the institution run by the Department of Sdd Human Resources & CE, General Advocate Tamil Nadu R Shunmugasundaram told the court to quote the prohibition of Religious and Amal (HR & CE) Hindu (HR & CE).
Submission was made in response to public interest petitions that challenged Hindu rules for recruiting staff to Arulmigu Arli Arts Arts and Science College, Chennai.

According to the applicant, the imposition of a condition that only Hindus that can submit a post is illegal, anti-constitutional and responsible for being hit.
He said that the State and Department of HR & CE have the authority to impose a condition that prohibits candidates from other religions to participate in the recruitment.
Noting that his condition directly violates the right to equality guaranteed based on Article 16 of the Constitution, the Applicant said, “This is a constitutional mandate that a country cannot discriminate against the basis of religion.” The only exception is to make an appointment for offices that are directly connected with religious affairs or their denominations, he said.
He added that the exception could not be claimed in recruitment to the assistant office of the educational institution.
Conditions in HR & CE Law that only those who claim to be Hinduism can be appointed in the department or regulated temples do not apply to educational institutions, he asserts.
“The term specific endowmen will not include educational institutions where there are no religious instructions that can be taught to students.
Obviously from the opening for the constitution that the state is secular and cannot choose religion and try to spread certain religious ideologies,” the Petitioner said.
