New Delhi: The Delhi High Court on Friday gave two weeks to the central government to submit a reply to the Delhi WAQF board to open Nizamuddin Markaz where the Congregation of Tabligh Jamaat was held in the middle of the Covid-19 pandemic and was locked since March 31 last year.
Justice Mukta Gupta said that until now, the Center did not submit a reply about Merit and asked if it was intended to file a reward at all.
“Do you want to file or not? On the first day you take the time to submit Affidavit,” The judge observed and clarified that the previous status report submitted by the center was only in connection with the opening of Markaz for the month of Ramzan.
Advocate Nair, appearing for the center, looking for one more chance of the court and said that he would file a brief reply to the petition.
The court was given three weeks to the council to submit an answer with the answer.
The problem was listed to hear further on September 13.
On April 15, the court has allowed 50 people to offer Namaz five times a day in Nizamuddin Markaz during Ramzan, said there was no direction in the Notification of Delhi Disaster Authority (DDMA) to close the place of worship.
The court allowed Namaz to be offered “the first floor above the basement” mosque, explaining that it must be “strictly appropriate” by notification of April DDMA and other standard operating protocols.
In the status report submitted by the Assistant Commissioner of Sub Sub-Police Lajpat Nagar, the central government has said the court “in wisdom and wisdom” can allow people like it according to fit and right to do Namaz only on the ground floor of the mosque in Nizamuddin Markaz tightly Follow all Covid-19 related protocols.
Without determining whether all places of worship are closed, such as those sought by the High Court, the report said DDMA notification prohibits all types of meetings after increasing Covid-19 cases apply to all religions.
The Board, in the request submitted through Advocates Wajeeh Shafiq, argues that even after opening up-1 guidelines that are permitted to place religious places outside the detention zone to be opened, markaz – consisting of Bangley Guardian Mosque, Madarsa-installed hostel – ULO – – Keep locked.
It is increasingly arguing that even if the place is part of a criminal investigation or trial, keeping it remain “under the key as a non-bound area” is the “primitive method” of the investigation process.
Several FIR has been registered under the Epidemic Law, Disaster Management Law, Foreign Law and various provisions for criminal codes in connection with the Jamaat tabli program held in Markaz and the next time of the Lightdown Covid-19 last year.
