New Delhi: The Supreme Court said the judges who passed the “oral direction”, especially on criminal things, were unacceptable and they had to hold back not to do it.
Hakim bench D Y Chandrachud and M R Shah said the text of the written command is what binds and publishes the oral direction does not form a part of the justice record and must be avoided.
The court issued observations while noting that one reserve of Judge Gujarat HC had passed the oral direction not to arrest the defendant in the case of forgery.
“The oral direction of this nature is responsible for causing serious doubts.
Judicial assessment changes with a list.
There are no written records of what has occurred during the judicial process, will determine a dangerous precedent if the parties and investigations are expected to rely on oral observations that are not recorded , “said the court.
