The Bombay High Court on Friday noted that the command of a blanket blanket on the media against any reporting against Bollywood actor Shilpa Shetty, the wife of the entrepreneur who was arrested by Kundra, would have a “terrible effect on the freedom of the press” and said there was a court.
Limit what can be interpreted as a good or bad journalism.
Judge Gautam Patel, however, directed that three videos uploaded on the YouTube channel of three individuals were removed and were not uploaded because they were “evil and even with the slightest effort to investigate the truth of the problem”.
The court noted that press freedom must be balanced with individual privacy rights.
The three videos made a comment on the status of the moral shetty and continued to question the quality of care after arresting her husband Raj Kundra in a case related to alleged production and streaming pornographic content on the application.
The court heard a suit filed by Shetty on alleged article of slandering published on him and family after arresting her husband on July 19.
Kundra (45) is currently imprisoned under the judiciary.
Shetty, in a temporary application, has been searching for media to be held from publishing content “wrong, false, dangerous and slanderous”.
Judge Patel, however, noted that the plaintiff’s prayer who was looking for media to be held will have a “cold effect on press freedom”.
“There are judicial limits on what is good or bad journalism because it is very close to the freedom of the press,” said the court.
The court noted that articles called shetty in his lawsuit did not seem to slander.
“It can’t be like if you (media) won’t write or say something good about me (shetty) then don’t say anything at all.
How can this happen?” Said Justice Patel.
The court noted that most of the articles referred to in the lawsuit, including those claimed that “Shetty cried and fought her husband Kundrra” when he was taken to their house by the police for joint interrogation based on what the police source said.
“Reportage Something based on what the police source said did not slander.
If this happens on the four walls of your house without being around then the problem is different.
But this happens before these outsiders.
How does this defamation?” Said Justice Patel.
The court added that the most this shows that the plaintiff (shetty) is human and there is nothing wrong with him.
“You choose life in the public eye then all this will come as part of the region.
Your life is under a microscope,” said Justice Patel.
The Shetty Birendra advisor also took objections with an article published on the website, ‘Peeping Moon’, where it was claimed that “the crushed evidence” shetty in her husband’s case was arrested.
Justice Patel, however, said he did not tend to direct for this particular article to be lowered when the material in it was the prime facie taken from an understanding of what was said or indicated by the police or indicated.
“There is no part of this sequence which is interpreted as a joke on the media,” said Justice Patel.
The actor application is also looking for damage to Rs 25 Crore, which states that respondents (some media publications and social media sites such as Google, Facebook, and YouTube) cause losses and damage to their repaired reputation.
In his request, Shetty looks for directions against social media platforms such as Google, YouTube and Facebook to remove all slanderous content related to it and their families.
For this, Judge Patel said, “Your prayer is looking for a social media platform like Google, YouTube and Facebook to exercise on dangerous editorial content.” HC directed all the defendants in the settings to submit written information and post this issue to hear further on September 20.
