Pay RS 57 Lakh to Hombuyer: HC to Supertech

New Delhi: The Delhi High Court on Monday asked Realtor Supertech to pay Rs 40 Lakh at the end of October to a home buyer, which has filed a complaint about the delay in giving villa ownership in one of the project companies in Yamuna Express, Industrial Development Area, adjacent to the National Capital .

The High Court heard Plea Supertech challenged September 20 where Arora was given a 3-year prison and an arrest warrant was released against him because of non-compliance with the direction of NCDRC.
The NCDRC case is related to the complaint of home buyers about the delay in providing villa in one of the company’s projects in the Yamuna Expressway Industrial Development Region, which is allocated for more than Rs 1 Crore.
Previously, Supertech’s advisor argued that NCDRC orders were beyond the provisions of Part 27 of the Consumer Protection Act and no provisions that provide a representative obligation to MD to make it responsible for criminal or civilian problems if there is a default by the company.
The request was opposed by a home buyer advisor who said the company was in the default repeatedly from the NCDRC sequence and had returned to the effort to the forum.
The High Court had been informed before that the arrest warrant was issued on September 20 by NCDRC which on September 13 rejected Supertech’s request to improve 12 months installments for payment of the decretal amount.
In April 2019, NCDRC had ordered the company to give villa ownership within six months, along with compensation and fees or returned all the amount received by compensation.
On July 20, MD has convinced NCDRC that the order will be fulfilled within 60 days.
However, on September 20, NCDRC noted that regardless of commitment, the command has not been implemented and argued that the company “avoided implementing decisions”.
Thus he issued an arrest warrant against MD and sentenced him to three years of respite subject to the implementation of orders within a week.
