Chandigarh: The Punjab High Court and Haryana have stated that the Jammu CBI branch jurisdiction to investigate cases related to the loss of youth in Punjab from 1992 to 1994 cannot be held illegal.
Justice Arvind Singh Sangwan passed this order while rejecting a lot of petitions raised by several police officers Punjab, now retirement, who were pulled by the CBI for the alleged kidnapping and murder of innocent people in Punjab during that period.
“Once a director was issued by SC to the director, the CBI, such strength was between him and therefore, policy decisions on February 7, 1997, gave the Siuxvi branch jurisdiction, herbal medicine, considering the direction of the APEX court could not be said to be illegal in what way Also, “observed Sangwan’s justice.
Disappearances in the CBI probe, some police will face the trial with this, several police officers charged with the CBI probe will face the trial in this case before the Special CBI court, Mohali in Punjab.
The cases against the police were registered in 1997 after SC’s direction to the CBI to be investigated.
In 1999, the CBI had submitted a cost sheet against the defendant but the trial in these cases could not be started because the defendant had approached HC and obtained the inap of the trial court process.
The Petitioner in this case has been looking for instructions to set aside orders on October 21, 2016, authorized by special judges, CBI, Patiala (now shifting to Mohali), where the application was submitted by the applicant to drop the process.
Their main request is that the CBI does not have territorial jurisdiction to register the case at your time despite the fact that all incidents are related to the state of the punjab.
It is said that the CBI is inherently not having jurisdiction under the Delhi Special Police establishment law, to operate at Jammu and Kashmir because the JAMMU unit does not have territorial jurisdiction outside the state of Jammu and Kashmir in accordance with the CBI manual.
However, Sumeet Goel, Senior CBI advice Standing handed over that this case was registered in the direction of the Supreme Court and after that the Jurisdiction of Siuxvi Kradu Jammu was extended to investigate these cases.
Goel claims that the CBI is very in the power to investigate this problem.
The senior advocate of R S Bains, who represents a complainant against the police, proposes that the applicant is used to submit a recurring petition, some of which have been dismissed by this court, only to postpone the trial.
After hearing all parties, HC argues that the CBI probe by the JAMMU unit cannot be said without jurisdiction as directed by the peak court.
The High Court, however, explains that all the shortcomings highlighted by the applicant before the court can be clarified from the peak or alternative court, they can seek further investigation in this matter.
