Chandigarh: Harmed by the delay in holding by-election in the Chair of the Ellenabad State Assembly in Sanda, a petition has been put forward before Punjab and Haryana High Court.
Ellenabad’s seat lay empty for about six months due to the resignation by Abhay Singh Chautala who was elected from Ellenabad on Inner tickets in the 2019 assembly poll Haryana.
The applicant has been looking for clues to the declaration of election election schedules by the election of assembly of 46-Ellenaabad in Haryana so there might be representation of people from this constituent in the legislative Assembly Haryana.
The assembly chair has been empty lying since January 27, which is more than six months.
Further direction has also been sought to start the necessary steps that adopt Covid-19 prevention measures, safety arrangements for the implementation of peaceful and fair elections for Ellenabad’s constituency constituency for the benefit of the general public.
The applicant has implemented Secretary of the Head of Haryana, the Indian Election Commission (ECI) and Chief Electoral Officer Haryana as the respondent.
This petition is expected to come to hear next week.
The petition submitted through Advocates Sandeep Goyat has proposed that more than six months have passed and there is no representation in the Legislative Assembly Haryana from the Constituency of Ellenabad and the Community Constituency facing many difficulties because of their non-representation of the electoral district.
It has also been stated that according to the part 151-a of the representation of Peoples Act 1951, a by-election to fill any vacancies must be held within 6 months from the date of occurrence but in this case the law period has passed.
It has also been stated that on May 5, ECI has announced to postpone the selection of three notification vacancies in parliamentary constituencies and eight vacancies in the assembly constituency including Ellenabad in Haryana.
It was decided by ECI which was due to the Covid-19 second wave outbreak in the country, inappropriate to hold back selection until the situation significantly improved and the condition became conducive to accommodate these elections.
According to the Petitioner when ECI announced to postpone the election, Covid-19 was at its peak but even at that time, the elections were held in several states and the election of Panchayat held at Uttar Pradesh too.
“In Ellenabad, it has arrived at the knowledge of the Petitioners that there are no active cases left and today are the most suitable time to hold elections.
There are almost no cases in the Ellenabad Assembly area and throughout the SANSA district,” PIL has filed in looking for instructions for Lowering bypoll under the Covid protocol.
It has also been stated in the petition that it does not act on behalf of the state government in sending input regarding the situation of the pandemic showing that the state government is not willing to do elections.
