Mumbai: Bombay High Court recently suspended a 10-year sentence and guarantees a man who was punished in 2019 for violations based on laws intended to protect children from sexual violators – Children’s protection from sexual violations (Pocso ).
The HC bench from the judge p D ride said the defendant had finished six years in prison, the record of the Prima Facie showed that the action of consensual and his lawyer Aniket Nikam had challenged the age of the victim, quoting a lack of documentary evidence.
The court court said it seems he was a party that agreed but because he was a minor event irrelevant.
Prosecutors P N Dabholkar argued that the girl was a minor, from a bad strata and denied that the action was consensual.
He said both of them living in the same area and the defendant would follow him on his way to school and after fir, the doctor found him 23 weeks pregnant.

HC after hearing all parties and through the note said Fir First did not mention the part 376 IPC (rape) or Pocso.
After a doctor’s report, they added.
HC also said the trial court also observed that while telling the history of crime, the girl had given a “different story” to a witness.
