Police to be told not to act arbitrarily in trade, business problems: ACS to HC

Prasagraj: Additional Secretary Head (ACS) Avanish Kumar Awasthi on Wednesday convinced Allahabad High Court that the right guidelines will be issued by the state government, directing the police authority not to act arbitrarily in matters related to trade and business after being shown by.
The court that regularly came across cases where the police had arbitrarily registered a shot below Section 420 (cheating) IPC to traders and entrepreneurs in commercial matters.
Previously, on Tuesday, the High Court had directed the ACS supervisor, home and jalaun from Police Ravi Kumar and Sub-Inspector Kedar Singh from the Police Station Nadi Gaon to stay personally before the High Court to show the reason why the right order could not be passed.
And why exemplary fees may not be charged on them to submit affidavit which is misleading in a case.
In addition, the court has also directed additional major secretaries, houses to produce ‘ease of business’ policies in the state.
The division bench consisting of Surya Prakash Kesarwani justice and the agrawal piyush justice heard the petition submitted by a Vishal Gupta, who had been seeking Arrangement of FIR which closes it on February 20, 2021, accusing cheating and not obeying orders passed by public servants.
In the petition, it was stated that the applicant was involved in the supply of goods.
In accordance with the accusation, the applicant took eight bundles of betel nuts and tobacco in his vehicle and asked by police sub-inspectors, he could not show a valid paper related to the transportation of the goods.
And for that reason, FIR is stabbed listed below 420 and 188 (disobedience to order correctly announced by the Public Server) IPC.
On Wednesday, ACS Home and SP Marks appeared before the High Court and submitted Personal Affidavit, stating that actions had been taken against police errors in the case and final report had been submitted after the investigation in the case.
The court said that arbitrary police actions to register shots in cases involving transportation of goods in ordinary business were the policy of “ease of business” from the country.
On Wednesday, by asking fresh Affidavit, ACS returned home told the court that a final report had been submitted in the case at the inn to the applicant.
Where, the court rejected the petition as ‘infructugia’ because the final report was submitted and there were no complaints from the remaining applicants.
Previously, on August 13, the court had observed that the nesting FIR against the applicant ‘reflects the bad intentions of the informant (sub-inspector) and the obstruction of trade and trade-free flows’, and directed the authority of the respondents to submit counter-affidavit in this case.
On August 18, the counter-affidavit was submitted by the Jalaun Police Supervisor (SP) where there was no application made by the applicants who were answered or the high court query was answered.
The High Court, in this case, directed the home of the additional major Secretary to submit a private affidavit in this case on August 24 submitted on August 23, 2021.
Furthermore, on August 24, 2021, the court, after reading the personal affidavit submitted by the Additional Secretary of the Head (ACS ), Houses and police supervisors, Jalaun has asked officers to stay present in court to submit a misleading written statement.
