KOLKATA: The Calcutta high court on Monday ordered ministry of a three-member board to track and organize with the return of individuals, that were allegedly made to flee due to post-poll violence, for their houses at Kolkata’s Entally region, and stated it is the job of the country to make certain law and order scenario is preserved.
The committee will include a leading official all of the National Human Rights Commission, West Bengal Human Rights Commission and the State Legal Services Authority.
Hearing PILs about post-poll violence at the nation, a five-judge led the committee to submit a record before it on July 4 if the issue will be heard .
Among those petitions was seeing 200 individuals, who had been supposedly not permitted to return to their homes in Entally constituency at Kolkata after meeting surveys were also concluded.
The chair led the committee to submit a report on whether people are allowed to go home and reside.
“The Committee will include an officer every nominated by the Chairperson of the National Human Rights Commission and the West Bengal State Human Rights Commission and the member secretary of the West Bengal State Legal Services Authority,” the seat ordered.
The bench, including acting chief oversight Rajesh Bindal and justices I Mukerji, Harish Tandon, Soumen Sen along with Subrata Talukdar detected that no individual could be made to avoid their home due to a danger to life.
“They got the right to reside inside their homes peacefully.
It’s the responsibility of the State to make certain law and order scenario is preserved,” the court observed.
The bench directed the people, that are supposedly not being permitted to go home, will carry on about the official email ID of the West Bengal State Legal Services Authority, wbstatelegal@gmail.
com, seeing issues being faced by them in return.
The bench ordered it will be the responsibility of the local authorities to make sure that each of the persons alleged to have been homeless are reinstated in their homes and they don’t confront any danger to their own life, freedom and property.
“In the event of any untoward event the local authorities will be liable, should they don’t keep peace, law and order in the region,” the seat ordered.
Advocate General Kishore Dutta, symbolizing that the country authorities, sought to dispute that the allegations of petitioner Priyanka Tibrewal which 200 individuals were homeless from Entally.
Dutta maintained that 39 of these have returned home, although a few are off on labor requirements or because of lock due to this Covid-19 pandemic.
Clashes were reported by many areas in West Bengal subsequent to the announcement of assembly election outcomes May 2.
Chief minister Mamata Banerjee had stated earlier this month which at least 16 individuals have lost their lives in post- poll violence from the state.
