Pune: National Green Tribunal (NGT) has directed the Secretary of the Head of State “to ask about the behavior of the person responsible for giving approval to operate” to the mining unit and rock crusher that is close to Tamhini wildlife asylum in Mulshi Taluka in Mulshi Taluka in Mulshi Taluka District Pune without environmental permission and environmental impact assessment.
The absence of an environmental permit to make the plant is truly illegal, a special bench from Green Tribunal said and added that permission to enable it to operate also violated the direction of the Supreme Court.

Supriya Dangre’s lawyer, representing the Laxman Thombare applicant, has submitted, among others, that the project is not in accordance with environmental norms because it does not have legitimate environmental permits for mining carried out on 10 hectares of land.

The same is 60 meters from the national highway, 100 meters from completion and 400 meters from villages that violate environmental norms.
The State Pollution Control Board, Forestry Department, Pune District Collector and Project Proponent has submitted their response to this problem.
The state pollution control board has notified that the measurement of surrounding air quality exceeds the standard of approval and mining more than permission.
In addition, the agreement to operate was given on August 14, 2019, subject to environmental permits.
The court observed that the Project initiator denied that it did not have environmental permits but failed to produce one and in the absence of mining environmental permits was illegal.
“Given the undisputed facts that there is no environmental permit obtained and there is no environmental impact assessment carried out as needed, all mining carried out by PP is illegal.
As a result, improvement actions need to be taken in the light of the Supreme Court’s assessment,” Tribunal said.
“The Joint Committee of the Central Pollution Control Board, the State Environmental Impact Assessment Authority, the State Pollution Control Board and the Division Commissioner, Pune, can assess the amount of compensation and supervise recovery, in accordance with the law,” added the bench.
