Justice Arun Kumar Tyagi from HC has passed this order while hearing the request submitted by a couple from the District of Sangrur Punjab.
The couple, claimed to be 17 years and 6 months and 28 years old, respectively, had approached HC looking for their lives protection and freedom at the average that they were married on June 16, 2021, at the residence of their friends in accordance with Hindu Rite and The ceremony of the wishes of relatives of girls and they capture threats to their lives and freedom in their example.
They also claimed that representation was given to the local police for protecting their lives and freedom but there was no action taken.
Responding to the petition, the adviser who represented the Punjab government, filed that the girl was less than 18 years falling in the definition of children under Section 2 (a) Prohibition of Child Marriage Law, 2006.
Part 9 of the Prohibition of Child Marriage Act, 2006, Provide punishment for someone who does a child’s marriage.
HC was told that the boy was not entitled to the custody of the girl and the girl had to be protected by sending it to child care institutions under the care of the Child Welfare Committee.
The girl also prayed to provide the protection needed to her on physical damage by her relatives.
Hearing this case, Tyagi’s justice directed the Chandigarh SSP to take over the prisoner of the girl and looked after it in Aashiana, Sector 15, Chandigarh, to ensure the protection of his life and freedom from his relatives.
“SSP Malerkotla is also directed at taking appropriate action for the protection of life and freedom of boys at his residence at this time as guaranteed by the perception / facts of the threat and circumstances of the case.
However, not in this order will prevent it (SSP Malerkotla) from.
Registering a criminal case against the boy and taking appropriate action against it in accordance with the law as guaranteed by the facts and circumstances of the case, “ordered Judge Tyagi.
Now the case has been fixed for July 23 for further hearing.
