New Delhi: The Supreme Court on Friday ordered Faridabad Municipal Corporation not to set aside illegal farming houses, commercial companies including hotels and religious structures in Aravali forest areas during sustainable trips to remove all encroachment inside and around the area of Khori Village.
Faridabad Municipal Corporation (FMC) through additional advocates General Arun Bhardwah told the judicial am Khanwilkar and Dinesh Maheshwari that the six-week deadline given by SC on June 7 to resolve all illegal structures on the forest land had run smoothly and 75 acres from 150 The hectare of violating forest land has been emptied of all encroachment.
However, he said that the six-week time limit was required to be expanded due to the special nature of the tasks and complexity involved.
The bench agreed to give four more weeks to FMC to complete the task.
At these points, Senior Advocate Colin Gonsalves attracted the attention of the court on RTI information obtained by officers of IAS Ashok Khemka related to the existence of a large number of agricultural houses, commercial companies including hotels and religious structures in forest land around the village.
“The eviction law should apply the same for the poor and rich and the impression should not go to the public that while poor settlers are expelled, rich people continue to live in a luxury farmhouse,” he said.
The bench said that the command was applied with the same rigidity as all types of encroachment in forest land.
“No need to observe that the command to eliminate all invalid structures will apply to all illegal structures without exception, including the structure that has been identified by the Forest Minister Harwar Kanwar Pal.

Importantly, the court allows the occupants of Khori Village to provide representation for modification in the design of Rehabilitation Policy 2021 framed by FMC.
Previous rehabilitation policies have improved 2003 as a cutoff date for the rehabilitation of khori rehabilitation.

The past policy imagined that those who had proof of residence in Khori Village before 2003 will be entitled to alternative accommodations.
SC asked FMC to consider the representation of the villagers within seven years.

SC allows residents to approach the FMC commissioner with complaints and ask the authorities to provide reasons in every case where temporary shelters and other facilities are not expanded to the evicted people.
However, the bench will not be feasible for FMC to provide advanced notice of the eviction of villagers after the FMC advisor shows that the area is sensitive and unwanted incidents can occur if the specific date for driving demolition in a certain area is notified.
