Jaipur: The High Court rejected the petition that challenged the suspension of Mayor of Jaipur-Greater Somya Gurjar on Monday.
The court directed the state government to resolve the judicial probe ordered by it on charges of persecuting the Jaipur-Greater commission, which caused its suspension, within six months.
The mayor has challenged his suspension under Section 39 of the Kotamaden Law Rajasthan, 2009.
The court after hearing had ordered orders on June 14.
The Hakya Division of CK Songara and Pankaj Bhandari, “We did not find any strength in the Instant Writ Petition and the same thing was dismissed.” We of the views considered that the decision (suspension) has been taken after the deliberation and application of the mind and after considering the investigation report Initial, the same thing could not be said to have been continued arbitrarily, “said the command.
Upholding the setting of the suspension issued by the local director of the body, the court said, “The suspension command cannot be said to be passed in hatred to overthrow the BJP Corporator as a BJP Corporator has been replaced by a BJP Corporator at the Mayor’s post.
On the fact, we did not find reasons for Set aside suspension orders.
“While upholding the validity of Section 39 (1) (D) (D) (II) and 39 (d) (d) (iii) from the 2009 law, the court said,” We did not find a reason to set aside suspension orders skipped by The appropriate authority.
“But noting the facts and circumstances of the case,” We consider it feasible to direct the state government to accelerate the judicial investigation which begins with it and the same thing is completed as far as possible within six months “.
The incident that caused suspension was a dispute regarding the contract extension given to the BVG company to collect garbage from the city.
In 2017, the previous corporation had provided work to BVG India Ltd to collect the door to the door, separation and transportation of city waste.
After Jaipur City Council was previously dissolved, on January 18 this year, the director of local agencies told the two companies (Jaipur-Heritage and Jaipur-larger) to enter additional agreements with the company for garbage collection.
Because of non-payment contributions by the corporation, the company has stopped garbage collection.
At the meeting of the first General Jaipur General Council, it was decided to take legal action that was appropriate to BVG within 30 days and invited fresh tenders to collect garbage.
Meanwhile, BVG obtained an interim fixed order from the High Court to support May 6.
The mayor called Commissioner JMC to discuss the issue on June 4 and allegedly several unward incidents occurred in the meeting room.
The Commissioner filed a complaint and submitted fir and seeking action against board members.
The government conducted a preliminary investigation and found the mayor and three board members guilty and ordered a judicial investigation.
It suspended the applicant from the Mayor’s post, Ward member No.
87, on June 6 along with three other board members.
Then, the government appointed BJP members of the Dhabai Board as a temporary mayor.
