Theni: Special Court then for the Criminal Case Court against MPs and MLA on Friday directing the Crime Branch Police (DCB) to register a case and ask complaints against the former Minister of Chief and Bodinayakur Mla O Panneerselvam and his son and MP Ravindranath Kumar that they have completed information Fake in a written statement submitted to fight for assembly 2021 and the 2019 LS selection.
The court issued an order while hearing two complaints favored by P Milany in court.
Magistrate Judicial N Panneerselvam said complaints had been submitted for alleged violations under Section 125 – a representation of the People’s Law.
In complaints, it was alleged that the defendants intentionally provided false information about their properties, annual income, educational liabilities and qualifications in a statement submitted along with their nomination paper.
The judge said that this case requires further deliberation by investigating the police to bring all the best truths and evidence in connection with the facts allegedly in complaints.
In addition, this case intrinsically assumes many public interests because this problem is related to the constitutional process of the selection of MLA and MP.
“This is the sadness of every citizen who is still struggling to conduct a fair selection in terms of constitutional provisions.
Therefore, we cannot provide an example by making this case demanding these cases through personal complaints.
This is the duty of every Government Agency for Taking the responsibility of the prosecution of these natural cases, “observed the judge.
The Judge said that it was a well-resolved law that when complaints were submitted under the 190 CRPC section, it was a prerogative of the judge to decide whether to continue under the part .200 CRPC (Judge who consumed personal complaints) or to provide direction for police investigations , taking into account the nature of each case.
